1. Introduction
Welcome to the Haytnir.am online platform (hereinafter referred to as the Platform). The platform has been developed in the framework of the “Multifaceted Whistle-Blowing Promotion in Armenia” project implemented by the Armenian Lawyers’ Association (hereinafter referred to as the ALA) with the support of the European Union based on the contract agreement with the “Open Government Partnership Europe” Foundation. Haytnir.am online whistleblowing platform is operated by the Armenian Lawyers’ Association, which is the copyright holder of the methodology of the Platform.
By accessing and/or using the Haytnir.am online platform, you acknowledge that you have read these terms of use (hereinafter referred to as the Terms), agree to be governed by them, regardless of whether you are a whistle-blower or a merely a visitor of the website.
You must be at least 18 years old to use the Platform. By using the website or agreeing to these Terms, you confirm and acknowledge that you are at least 18 years of age. Persons under the age of 18 may use the Platform through the account of a parent or guardian and under their supervision. If you represent a legal entity, you acknowledge that you have all rights granted by the legal entity under the law to use the Platform. By agreeing to these Terms, you acknowledge that we cannot verify the information and data provided by you, or the authenticity of your statements made in this clause, therefore you bare all responsibility for any violation of this clause.
ALA reserves the right to change these Terms at any time, unilaterally, without prior notice, therefore the Visitor is obliged to check in advance for changes to the Terms each time he accesses the platform.

The Haytnir.am online platform (including, but not limited to, content, images, photos, graphics, design and their selection, coordination and regulation) is protected by copyright legislation of the RA. All copyrights of the website belong exclusively to the ALA and are fully permitted by the Law of the Republic of Armenia "On Copyright and Related Rights" as well as all international legal norms on copyright.
The Haytnir.am online platform provides you the right to study, copy, download, distribute, make available to third parties and print the content of the website under the following conditions:
1) The information shall be used and distributed solely for personal, informational and non-commercial purposes without the prior written consent of the ALA.
2) Quoting the content of the Haytnir.am online platform, shall comply with the provisions of the Law of the Republic of Armenia "On Copyright and Related Rights".
3) Changing, modifying or adapting the materials is prohibited.
3. Trademark
The name and brand of Haytnir.am online platform distinguishes the ALA services and allows the public to recognize the provider of these services. Visitors may not use the trademark of the Haytnir.am online platform without the prior written consent of the ALA. The exception is only for the mass media. Visitors do not have the right to use the trademark of the Haytnir.am online platform for the following purposes:
1) In a trademark, brand name or publication title not related to the services of the Haytnir.am online platform.
2) As a trademark or brand name of the visitor or part thereof.
3) To identify services not related to the platform.
4) To cause confusion/delusion.
5) To indicate as a sponsor of the visitor's services or as a collaborator with the visitor, unless ALA's written consent is available.
4. Privacy
Any personal data provided for the purpose of submitting an application on the Haytnir.am online platform will be used in accordance with the Privacy Policy. By accessing the website, you acknowledge that you understand and agree to the information collection, use and disclosure practices of the ALA included in these Terms and described in the Privacy Policy.
5. Limitation of Liability
1. Visitors use this website at their own risk. This website is provided on an «as is» and «as available» basis, without making any claims and contractual warranties, including, but not limited to contractual claims and warranties relating to the use, availability, full display, reliability or suitability of this Platform for any of the stated objectives. The visitors are fully and exclusively responsible for all risks associated with the use of these services.
2. ALA takes all necessary and reasonable steps to keep the Platform operational, and to eliminate and prevent potential website problems as quickly as possible. However the ALA is not responsible for the consequences of possible deficiencies of the Platform. ALA makes no warranty that this website will meet all expectations of the visitors; that it will work in a timely manner, smoothly, reliably, and without fail, that any defects and errors will be corrected, or that any data, information, reports, or the results obtained in the use of this site will be exact and reliable for any purpose. You should not assume that the website or its content has no errors or that it meets the specific goals that the visitors have in mind while using it.

The ALA has no liability for any damages arising out of the use or loss of the use of this website or other sites accessible via links or any other action that the visitors can perform or skip relying on the information contained on this website, including, but not limited to direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. The visitors are fully and solely responsible for all of the above.

The Haytnir.am online platform may contain advice, opinion or other information from various sources, which are for informational purposes only and are aimed at corruption crimes, violation of conflicts of interest requirements of public servants, violation of codes of conduct, incompatibility requirements, and other restrictions or violation of the declaration requirements or other offenses or violation of the requirements on providing general information and raising awareness. The published information in relation to each specific case cannot be qualified as legal or other professional advice provided by the team of the ALA/Haytnir.am online platform.
Reliance on any such opinion, advice, statement or other information is at your own risk and the organization shall not be liable for any damages arising from the use of the information contained on this website. It is also recommended to obtain professional advice prior to using any content from the Website.
Exceptions to this provision are the advice and clarifications provided to you in connection with applications that you have submitted, which may be qualified as such, without limiting your right to obtain professional advice from other sources.

8. Misuse of the Website
It is prohibited to:
- Use the Website in such a way or carry out any activities that damage or may damage the Website or impair its performance, accessibility, availability, continuity, security or pose a risk of data leakage;
- Use the Website in a manner that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity, including the use of threatening, abusive, violent, disrespectful, defamatory, racist ethnic or by uploading, posting, sending by email or other transmission of content and vocabulary containing elements of an objectionable nature;
- Intentional or unintentional actions by the whistleblower that may lead to the access by the third parties of the code necessary to access his/her personal domain and check the status of the application. The whistleblower realizes that in any case the actions carried out from his/her personal domain are considered as a direct and true expression of his/her will;
- Accessing the personal domain of the whistleblower using the code of another person. The Whistleblower undertakes responsibility to immediately notify the Platform in writing (by filing a statement or otherwise) if he becomes aware of any disclosure and unauthorized use of the code;
- In the case of reporting by revealing the identity, to act on behalf of other persons or intentionally using the names similar to the names of other persons /e-mail/ phone number, and/or other data;
- Hack the website or otherwise interfere with the operation of the website;
- Without prior written permission of the ALA to research, investigate or test the vulnerability of the website;
- Circumvent any authentication or security system or process of/or associated with the website;
- Use the website to copy, store, submit, transmit, send, use, publish or distribute any material containing (or related to) any spyware, computer virus, "Trojan Horse", "Web Worm", "Keyboard Spy" or other harmful computer program;
- Place an unreasonable burden on the website resources (including limiting bandwidth, storage capacity, and processing capacity);
- Decrypt or decode messages sent from or to the website without the express written consent of the ALA;
- Conduct routine or automated data collection activities on or in relation to the website without express written consent of the ALA (including, without limitation, data scraping, data mining, data extraction, data harvesting) except for the information included in “Statistics” section of the website;
- Access the website or otherwise interact with the website using Search Engine Robots & Spiders. Search engine robots or other automated means for non-search engine listings;
- Perform any action contrary to the normal use of the website;
- Use the information collected from the website for direct marketing purposes (including without limitation e-mail marketing, SMS marketing, telemarketing and e-mail advertising);
- Use the data collected from the website for the purpose of establishing contact with individuals, companies or individual and legal entities.
9. Compensation for damages
You agree to compensate ALA and/or any third party for any damages caused to the ALA and/or any third party as a result of your unlawful conduct;
10. Termination
ALA reserves the right to remove or not process any application/report that are considered to be in violation of the Terms of Use, in particular, including content and language containing elements of threatening, offensive, violent, disrespectful, defamatory, racist, ethnic or otherwise objectionable nature. In addition, specialists of the Haytnir.am online platform have the right to edit the reports/applications from the point of view of spelling, wording and syntax, leaving the content unchanged in case of submission to the competent authorities.
ALA reserves the right at any time, including without prior notice, to restrict, suspend or terminate access to the website to any user who, in its sole discretion, is found to be in violation of these Terms of Use.
ALA may terminate this Agreement for any reason and at any time, in whole or in part. Termination of any provision of this Agreement shall not suspend the continued application of the remaining provisions.
11. Changes
ALA reserves the right to modify these Terms and any other policies applicable to the Platform or posted on it. In the event of changes to the Terms, the Platform will post the updated Terms on the Website, indicating the date of the last change.
Such changes will be effective immediately upon being posted on the Platform and will apply to obligations arising from the latter after posting the changes on the website. Your continued use of this website will be considered as your unconditional consent to the changes in the Terms.
12. Dispute Resolution (Jurisdiction)
Visitors hereby agree that prior to applying to a court or other competent authority, all disputes and matters arising out of or in connection with the use of this website or websites connected with this site via a hyperlink or otherwise, visitors shall file their claim writing and submit to the ALA or the Platform. . Such requests are processed by the ALA within a reasonable time.
Any disputes arising between the ALA and the visitors of the Platform in connection with these Terms shall be subject to final settlement in the courts of the Republic of Armenia, in case of failure to reach an agreement within 60 (sixty) days from the date of origin of such disputes.
13. Applicable Law
All matters and disputes arising out of or in connection with the use of this Platform or any service provided via this Platform shall be resolved in accordance with the substantive norms of legislation of the Republic of Armenia.
14. Other Provisions
These Terms of Use constitute an agreement between the ALA and you regarding the use of the website. If any provision of these Terms of Use is considered void, the remaining provisions shall remain in full force and effect.
